Detectives said there was a possibility of a scuffle before Mwathi was dragged outside and thrown from the roof or down the stairs of a 12-story building.
Investigators believe, barring suicide, that Mwathi was murdered before he was deported to cover up and simulate suicide.
Mwathi was originally thought to have jumped out of a bedroom window, but this has been ruled out as an adult cannot enter narrow window frames.
On Friday morning, homicide detectives investigating Mwathi’s death released a report showing that the trial included questioning the first witnesses in the case, forensic examination of the crime scene, and retrieval of closed-loop CCTV footage showing the captured last moments of the deceased.
Investigators said they are now entering the second phase of the investigation, during which several individuals will be interviewed and appropriate recommendations will be forwarded to the Office of the Director of Public Prosecutions (ODPP).
,
Investigators said people to be interviewed in the next phase would include the five people who were at DJ Fatxo’s home on the morning of February 22, 2023, when the incident occurred.
According to the DCI, the police officers who first handled the case should also be interviewed.

DCI Homicide detectives took over the case from the Kasarani police station last week on the orders of Cabinet Secretary for Internal Affairs Prof. Kithure Kindiki.
